This is a personal injury action arising out of a rear end automobile collision. Plaintiff John William Hines (hereafter called appellant) brought suit against defendant Monte Nelson (hereafter called appellee) for injuries sustained as a result of appellees employee, Joseph B. Whitefield, causing the tractor-trailer truck which he was driving to collide with the rear end of appellants automobile while the latter was stopped in obedience to a red traffic signal at an intersection. The case was tried before the court and jury, and upon the findings of the jury a take nothing judgment was rendered for appellee.
